What is an EC Rep? The Complete Guide for Non-EU Sellers (2026)

What is an EC Rep? The Complete Guide for Non-EU Sellers (2026)

If you sell physical products to customers in the European Union and you are based outside the EU — in the United States, the United Kingdom, China, Turkey, or anywhere else — you have likely come across the term EC Rep. This guide explains exactly what an EC Rep is, who needs one, what they do, and how to appoint one correctly.

The Short Answer

An EC Rep (short for European Community Representative, also called an EU Authorised Representative or EU AR) is a legal entity — a company or individual — physically located inside the European Union that acts as your official point of contact for EU product safety authorities.

Under EU law, if you manufacture or sell physical products to EU consumers and you are not based in the EU yourself, you are legally required to appoint an EC Rep before your products can be placed on the EU market.

Why the EU Requires an EC Rep

The EU needs a contact point inside its territory for every product on its market. When a product causes harm, when authorities need to recall it, or when documentation must be inspected, they cannot rely on a company based in China, the US, or the UK to respond within EU legal timeframes.

The General Product Safety Regulation (GPSR, EU 2023/988), which came into full force on 13 December 2024, made this requirement explicit and enforceable for all consumer products — not just regulated product categories. Before GPSR, only specific sectors (medical devices, toys, electronics under CE marking) required an EU representative. Now, every non-EU seller of physical consumer goods needs one.

The regulation states in Article 4:

"Where the manufacturer is not established in the Union, the manufacturer shall ensure that a responsible person established in the Union is designated for the product."

This "responsible person" is what most sellers call an EC Rep or EU Authorised Representative.

EC Rep vs. EU Authorised Representative — Is There a Difference?

The terms are used interchangeably in practice, but there is a subtle distinction worth understanding:

Term Context Legal Basis
EC Rep Older term, used in CE marking directives (e.g., Low Voltage Directive, Machinery Directive) Various product-specific EU directives
EU Authorised Representative Broader term used in GPSR and newer regulations EU 2023/988 (GPSR), EU 2024/1781 (ESPR)
Responsible Person The GPSR-specific term for the EU contact point EU 2023/988 Article 4
Economic Operator Platform term (used by Amazon, Etsy) for the EU contact Platform compliance policies

For most non-EU sellers on Amazon, Etsy, Shopify, or eBay, all four terms refer to the same role: a legally registered entity in the EU that takes on responsibility for your product's compliance with EU law.

What Does an EC Rep Actually Do?

An EC Rep is not just a postal address. Under GPSR, they have specific legal obligations:

1. Maintain technical documentation. Your EC Rep must hold your product's technical file — safety assessments, test reports, declarations of conformity — and make it available to EU authorities on request within a defined timeframe (typically 10 days for serious risks, up to 30 days for standard requests).

2. Act as the official contact point. EU market surveillance authorities (customs, consumer protection agencies, national safety bodies) will contact your EC Rep if there is a product safety concern. The EC Rep must respond and cooperate.

3. Register products in the EU Safety Gate. For certain product categories, the EC Rep must register products in the EU's Safety Gate portal (the EU product safety database).

4. Coordinate recalls and corrective actions. If a product is found to be unsafe, the EC Rep coordinates the recall process with EU authorities on your behalf.

5. Appear on product labelling. Under GPSR Article 19, the name and address of the Responsible Person must appear on the product or its packaging. This is a physical labelling requirement, not just a database entry.

Who Needs an EC Rep?

You need an EC Rep if all three of the following apply:

  1. You are not established in the EU (your company is registered outside the EU)
  2. You sell physical consumer products (not digital goods, not services)
  3. Your products are sold to EU customers — whether directly through your own website, or through a marketplace like Amazon EU, Etsy, or eBay

You do NOT need an EC Rep if:

  • You are an EU-based company (even if you sell globally)
  • You sell exclusively digital products or software
  • You only sell B2B to EU companies who then resell (in this case, the importer takes on the responsibility)

Practical Examples

Seller Needs EC Rep?
US-based seller on Amazon.de Yes
UK seller on Amazon.co.uk selling to EU customers Yes
Chinese manufacturer selling on Etsy to EU buyers Yes
Turkish Shopify store with EU customers Yes
German GmbH selling on Amazon.com No (EU-based)
US software company selling SaaS to EU No (digital product)

What Happens Without an EC Rep?

The consequences of not having an EC Rep are serious and have become more actively enforced since December 2024:

On Amazon: Amazon requires sellers to submit Responsible Person information for every ASIN sold to EU customers. Missing this information results in listing deactivation for EU customers, compliance violations appearing in Account Health, and potential account suspension for repeated non-compliance.

On Etsy: Etsy requires sellers to designate an Economic Operator (their term for EC Rep) at the shop level. Missing information can result in listing restrictions and shop suspension.

From EU authorities: Market surveillance authorities can issue fines, order product recalls, and ban products from the EU market. Under GPSR, fines can reach up to 4% of annual turnover or €10 million, whichever is higher, for serious violations.

How to Appoint an EC Rep

Appointing an EC Rep involves three steps:

Step 1: Choose a service provider. Several companies offer EC Rep services for non-EU sellers. Look for a provider that is legally registered in an EU member state, has experience with your product category, provides a written service agreement, and can provide their details for product labelling.

Step 2: Sign a written mandate. The EC Rep relationship must be formalised in a written agreement that specifies the products covered, the obligations of both parties, and the duration of the arrangement.

Step 3: Update your product information. Once appointed, you must add your EC Rep's name and address to your product labelling (or packaging insert), submit their details to Amazon and other platforms for each affected ASIN, and include them in your product's Declaration of Conformity where applicable.

How Much Does an EC Rep Cost?

EC Rep services vary significantly in price and quality. Based on current market rates:

Service Level Typical Price Range What Is Included
Basic address service €5–20/month EU address only, no real compliance support
Standard EC Rep service €49–199/month Full legal representation, documentation holding, authority liaison
Premium / managed service €200–500/month Active compliance management, labelling review, multi-product support

Warning: Some providers offer very cheap "EC Rep" services that are essentially just a postal address. These do not meet the legal requirements of GPSR, which requires the representative to actively hold documentation and respond to authorities. Using an inadequate provider can leave you legally exposed even if you technically have an "EC Rep" on file.

EC Rep for Amazon Sellers: What Amazon Requires

Amazon has its own specific requirements for the Responsible Person information submitted through Seller Central:

  • The Responsible Person must be physically located in an EU member state
  • Their name, postal address, and contact email must be submitted for each ASIN
  • The provider must not appear on Amazon's list of invalid Responsible Person providers
  • The information must match what is on the product labelling

Amazon validates submitted Responsible Person information and will reject submissions from providers it has flagged as non-compliant. Always verify that your chosen provider is accepted by Amazon before committing.

Frequently Asked Questions

Can I use a friend or family member in the EU as my EC Rep? Technically yes, but practically this creates significant legal risk for that person. They would be personally liable for your product's compliance with EU law. Most legal advisors recommend using a professional service provider.

Does my EC Rep need to be in a specific EU country? No. Any EU member state is acceptable. Slovakia, Germany, the Netherlands, and Ireland are common choices due to their business-friendly environments and English-language services.

Do I need a separate EC Rep for each product? No. One EC Rep can cover all your products, provided the service agreement specifies all product categories and the EC Rep holds documentation for each product.

How quickly can I get an EC Rep? Professional services typically issue the mandate within 24–48 hours of signing up. This means you can resolve Amazon compliance violations within 2–3 business days in most cases.

Is an EC Rep the same as a CE marking representative? CE marking representatives and GPSR Responsible Persons serve similar functions but under different legal frameworks. If your product requires CE marking (electronics, toys, machinery), you may need both — though many providers cover both requirements under a single service agreement.

Summary

An EC Rep — also called an EU Authorised Representative or Responsible Person — is a legally required EU-based contact point for non-EU sellers of physical consumer products. The requirement applies to all consumer goods sold to EU customers under GPSR (EU 2023/988), which has been in force since December 2024. Without one, your Amazon listings will be deactivated for EU customers, and you face potential fines from EU authorities.

Appointing an EC Rep involves choosing a qualified service provider, signing a written mandate, and updating your product labelling and platform information. The process typically takes 24–48 hours with a professional provider.
