EU Compliance for Online Sellers — The Complete Beginner's Guide

Part 1 — What are the rules and who made them?

The EU has passed three regulations that affect every non-EU seller shipping physical products to European customers.

Regulation 1: EU 2019/1020 — Market Surveillance This law says that if you sell products in the EU and you are not based in the EU, you must appoint a legal representative inside the EU. This person or company takes legal responsibility for your products. Their name and address must appear on your product label.

Regulation 2: GPSR — General Product Safety Regulation (in force since December 2024) This law says that every product sold to EU consumers must be safe, and you must be able to prove it. You need safety documentation, a way for customers to contact you, and your EU representative's details on the label.

Regulation 3: ESPR 2024/1781 — Ecodesign for Sustainable Products Regulation This is the law that creates the Digital Product Passport. It requires that physical products have a QR code that links to a digital record showing what the product is made of, where it comes from, and how to recycle it. The first products affected are textiles and batteries in 2027.

Part 2 — Do these rules apply to you?

Yes, if all three of these are true:

• You are based outside the EU (Turkey, Pakistan, China, UK, USA, India, Bangladesh, Vietnam, etc.)
• You sell physical products (clothing, electronics, furniture, toys, cosmetics, bags, shoes, etc.)
• You sell to customers in EU countries through Amazon, Etsy, Shopify, WooCommerce, or your own website

No, if:

• You only sell digital products (software, ebooks, courses)
• You only sell to customers outside the EU
• You already have a registered company inside the EU that handles your products

Part 3 — What happens if you do nothing?

What is happening right now (2024–2025)

Amazon has already started removing listings from sellers who cannot prove they have an EU Authorized Representative. Market surveillance authorities in Germany, France, and the Netherlands are conducting random checks. They scan QR codes on products in warehouses. If the code leads nowhere, or if there is no EU representative name on the label, the product is seized and the seller is fined.

What changes from late 2026 — the customs system

The EU is building a central digital system called the EU DPP Registry and connecting it to the EU Customs Single Window (EU CSW-CERTEX). This system goes live in 2026.

When your shipment arrives at an EU port or border crossing, the customs computer automatically checks three things:

1. Is there a valid Digital Product Passport registered for this product?
2. Is the EU Authorized Representative code valid and active?
3. Does the HS code on the customs declaration match the DPP record?

If all three match — the shipment is cleared. If any one of them is missing or wrong — the shipment is automatically blocked. No human decision. No appeal on the spot.

What freight forwarders and logistics companies are doing

Under Article 4 of EU Regulation 2019/1020, if a non-EU seller cannot prove they have a valid EU Authorized Representative, the freight forwarder or fulfillment provider becomes legally liable for the products they handle.

The consequence: DHL, Kühne+Nagel, Amazon FBA, and other logistics providers are increasingly refusing to accept shipments from non-EU sellers who cannot provide proof of EU AR and DPP compliance.

Part 4 — What you need to do, step by step

Step 1 — Get an EU Authorized Representative

An EU Authorized Representative is a company based in the EU that puts their name and address on your product label, registers your products with EU authorities, and takes legal responsibility if a product causes harm.

Step 2 — GPSR Compliance Check

GPSR requires that your products are safe and that you can prove it. For most standard products (clothing, furniture, bags, shoes, household items), this means having test reports or a safety declaration, your EU representative's details on the label, and a way for customers to contact you.

Step 3 — Create your Digital Product Passport

A Digital Product Passport is a digital record for your product with a QR code. You create this record once in AuraDPP. The system generates a QR code. You print this QR code on your product label or packaging.

Part 5 — The total cost, realistically

A typical small seller with 10 products pays €118/month (EU AR Starter €99 + DPP Starter €19). For context: one Amazon listing suspension typically costs €500–€5,000 in lost sales and reinstatement fees. One shipment blocked at EU customs costs €200–€2,000. The monthly cost of compliance is less than the cost of one incident.

Part 6 — The timeline at a glance

Common questions

"I sell through Amazon FBA. Does Amazon handle this for me?" No. Amazon requires you to provide a valid EU Authorized Representative. They do not provide this service.

"My freight forwarder said this is not required yet." GPSR has been in force since December 2024. The EU AR requirement has been in force since 2021. If your freight forwarder says it is not required, they are referring to the DPP specifically. The EU AR is required now.

"What if I get caught without an EU AR?" Fines in Germany can reach €100,000. Amazon account suspension is immediate and can take weeks to resolve.
